News & Notes 906:Communication between ATDC and AVC
Communication between Entity::ATDC and Entity::AVC
Dear Community, for your information, we are sharing an email sent to ATDC on January 7th 2022 as a response to their note on Auronet dated 28th December 2021. https://auroville.org.in/article/88278
To this we received a response from them informing us that the concerned matter is sub-judice, and they do not want to discuss it unless and until the case is cleared by National Green Tribunal. We wish that we can create bridges so that all our differences can be resolved internally.
Warmest regards and Happy Pongal.
“Dear ATDC, the Auroville Council is concerned by the dynamics in our community and especially by the lack of agreement of which your publication on Auronet dated 28.12.2021 is one of the strongest indicators.
We agree as you state that “the Crown development work has to continue in compliance with Sections 19(2)(c) and 17(e) of the Auroville Foundation Act”.
However, as per the 57th minutes of the Governing Board (GB) you have erroneously interpreted their “view” as a “decision”. As per section 17(e) of the Auroville Foundation Act, the GB is to “prepare a master-plan of Auroville in consultation with the Residents’ Assembly and to ensure the development of Auroville as so planned.” Opposed to this you are suggesting that the ATDC should impose the development, without due process and requisite plans, against the recommendations of the RA, and this on behalf of the GB.
As you have misinterpreted the minutes of the GB and at the same time intend to ignore the RA’s internal processes, although you are constituted by the RA, we must on these grounds alone place your office appointments and legitimacy in question.
On behalf of the RA, you are reminded of your legal obligation to the RA as one of the 3 authorities of the Auroville Foundation. As per AVFA 17(c), GB is to “accord approval to the programmes of Auroville drawn up by the Residents’ Assembly”. Until the GB has had the opportunity to receive the recommendations of the RA and accord approval to said activities for the development of Auroville you are requested to respect the decisions of the RA.
We might publish this information to the community but before doing so, we would like your input.
As you have suggested, we confirm the meeting for Tuesday 11th at 10am at AvC meeting room.”
Warm regards,
For the Auroville Council,
Balaji, Claudine, Ganesh K., Suryan, Shivaya, and Shiva
